5. Any person, whether or not a passenger, who has in his/her possession or in his/her checked baggage, alcoholic beverage or any container thereof, in quantities greater than those specified herein, may be proceeded against and may be subject to criminal penalties.

6. In addition to the above, passengers may carry in their checked baggage one (1) empty unopened glass bottle of wine or champagne or other alcoholic beverage, provided the container has a capacity of not over 70 litres (19 gallons).

Is it Illegal to Drink your own alcohol on an airplane?

You cannot drink your own alcohol on board an aircraft. However, you can still enjoy a cocktail with friends after landing.

In most countries, it is illegal to drink alcohol on a plane. It’s a rule most of the world follows, and one enforced by the Transportation Security Administration.

What happens if you caught drinking your own alcohol?

But, as a frequent airline traveller, you may be wondering, what if someone caught you drinking, even if it was just a single liquids in bottle of wine?

You cannot drink alcohol that is in your possession while onboard. This includes shipping alcohol that you have purchased and alcohol that you have made.

If you are found drinking your own alcohol, you might end up in a sticky situation. Then you could face fines ranging anywhere between $500-$1000 for each violation.

The fine depends on where you fly out of. Some airports charge higher fees because they believe people are trying to smuggle booze into the country.

The FAA advises that you will be subject to the same penalties as any other adult and will be required to surrender the alcohol and it will be confiscated and may be destroyed.

Note that a passenger can bring his or her own litre of alcohol on a flight as long as it is in his or her carry-on luggage for couple of beer bottles. The passenger may not consume alcohol on their long-haul flight.
